Welcome to Vovalet. These Terms and Conditions (“Terms”) govern your use of our platform and services, including but not limited to the booking of rides, payments, cancellations, and disputes. By using Vovalet's services, you accept and agree to abide by these Terms. Please read them carefully.
1. Introduction
These Terms apply to all users of Vovalet's ride-booking platform, including passengers, drivers, and any third parties who access or use our services. By using the services provided by Vovalet, you agree to these Terms. If you do not agree with these Terms, you should not use our services.
2. User Eligibility
- Minimum Age: You must be at least 18 years old to book a ride with Vovalet.
- Valid Payment Method: You must provide a valid payment method at the time of booking a ride. If the payment is not authorized or processed, Vovalet reserves the right to cancel the ride and deny future bookings until the payment issue is resolved.
- Account Responsibility: You are responsible for maintaining the confidentiality of your account details, including your login information and password. You must notify Vovalet immediately if you suspect any unauthorized use of your account.
3. Payment Terms
- Pre-Authorization: At the time of booking a ride, we will pre-authorize the expected cost on your chosen payment method. This authorization holds the funds but does not charge them. The pre-authorization is canceled immediately once the ride is booked, and a new transaction is initiated for the final amount once the ride is completed, including any additional charges, if applicable.
- Final Payment: Funds will be charged after the ride is completed. If there is a problem with the payment, such as insufficient funds or declined transactions, you will not be able to book any additional rides until the payment issue is resolved.
- Overage Charges: If the ride exceeds 10 minutes over the expected duration, you will be charged an additional $0.50 for each minute that exceeds the extra 10 minutes. Additionally, toll prices may change or differ from when the ride was first booked. As a result, the final fare could vary due to any changes in toll pricing.
- Tolls and Additional Charges: For hourly rides, tolls and other incidental charges (such as parking fees) will be added to the final amount, and these are not included in the base fare.
- Additional Toll Charges: Vovalet reserves the right to charge for any additional toll usage that was not charged at the time of payment, up to 14 days after the ride.
4. Booking and Cancellation Policy
- Booking Confirmation: A booking is confirmed only when you receive an email or notification from Vovalet confirming your reservation. Until you receive this confirmation, your booking is not guaranteed.
- Cancellation Fees:
- Within 1 Hour of Pickup: If you cancel a ride within 1 hour of the scheduled pickup time, you will be charged the full cost of the ride up to a maximum of $60 as a cancellation fee.
- Outside of 1 Hour of Pickup: If you cancel a ride more than 1 hour before the scheduled pickup time, you will not incur any charges.
- No-Show Policy: If you do not show up at the designated pickup location within 20 minutes of the scheduled time, and have not communicated with Vovalet about the delay, the ride will be canceled, and you will still be charged the full amount.
5. On-Ride Conditions
- Passenger Conduct: You agree to behave responsibly and respectfully during the ride. This includes, but is not limited to, refraining from abusive language, physical violence, or damaging the vehicle.
- No Smoking or Alcohol: Smoking and consumption of alcohol are strictly prohibited during the ride. If the driver observes any of these activities, they have the right to terminate the ride immediately, and you will still be charged.
- Failure to Arrive at Pickup Location: If you do not arrive at the pickup location within 20 minutes and have not communicated with Vovalet about the delay, the ride will be canceled, and you will still be charged the full amount.
- Intoxication or Disruptive Behavior: If you are found to be too intoxicated or disruptive, the driver may terminate the ride. You will be dropped off at a safe location, but you will still be charged for the ride.
6. Event Bookings
- Non-Cancellation Policy: Event bookings cannot be canceled within 24 hours of the scheduled pickup time. Any cancellation made within this timeframe will result in the full charge of the ride.
- Booking Confirmation: Your event booking is confirmed only when you receive an official confirmation from Vovalet. Until then, your booking is not guaranteed.
- Extended Wait Times: Due to the nature of events, drivers will wait up to 30 minutes beyond the scheduled pickup time before marking a no-show. After this period, the booking will be canceled, and you will be charged the full fare.
- Peak Pricing: Event bookings may be subject to peak pricing due to high demand. Final charges will be based on real-time availability and traffic conditions.
- Changes and Modifications: Any modification to an event booking (such as changes in pickup location or time) must be made at least 24 hours in advance and is subject to availability.
7. Damages to the Vehicle
- Responsibility for Damages: You are responsible for any damage caused to the vehicle during the ride. This includes damage to the interior or exterior of the vehicle.
- Charges for Damages: If the vehicle is damaged, Vovalet reserves the right to charge your payment method for the cost of repairs or cleaning.
8. Driver’s Rights and Responsibilities
- Right to Refuse Service: Drivers have the right to refuse service to any passenger who is engaging in unsafe or disruptive behavior, including intoxication, aggressive behavior, or refusal to follow safety instructions.
- No Detours: Drivers are not required to take detours or make stops that are not included in the initial booking without prior approval and an adjustment to the fare.
- Insurance Coverage: Vovalet drivers are covered under appropriate insurance policies required by law, ensuring the safety of both passengers and drivers during rides. Passengers should also be aware that in the event of an accident, all parties involved are responsible for their respective liabilities.
- Background Checks: All drivers undergo background checks, including criminal record reviews, to ensure the safety and security of passengers. These checks are updated regularly.
9. Service Availability
- Service Limitations: Vovalet operates only in specific areas, and service availability is subject to geographical limitations. Please check the service area map on the Vovalet app or website to confirm if service is available in your location.
- Maintenance and Outages: From time to time, there may be planned or unplanned maintenance, outages, or updates to the app or website. Vovalet will make reasonable efforts to minimize any downtime and keep users informed of any disruptions.
10. Limitation of Liability
- No Warranty: Vovalet makes no representations or warranties regarding the availability, accuracy, or reliability of the services provided. The service is provided "as-is" and "as available."
- Limitation of Liability: Vovalet shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the service, including but not limited to delays, cancellations, accidents, or injuries during a ride.
- Force Majeure: Vovalet is not responsible for delays or failures to perform due to circumstances beyond our control, including but not limited to extreme weather, road closures, government orders, natural disasters, or accidents.
11. Dispute Resolution
- Informal Resolution: In case of any dispute, Vovalet encourages informal resolution through direct communication with our support team.
- Binding Arbitration: If a dispute cannot be resolved informally, it will be submitted to binding arbitration under the rules of the jurisdiction in which Vovalet operates. The arbitration decision will be final and enforceable.
12. Privacy and Data Protection
- Data Collection: By using Vovalet's services, you agree to the collection and use of your personal data as described in our Privacy Policy. This includes information such as your name, contact details, payment information, and ride details.
- Data Sharing: Vovalet does not sell or rent your personal data to third parties. However, we may share your information with third-party service providers or partners necessary to provide our services (such as payment processors or insurance providers).
- Third-Party Services: Vovalet may integrate third-party services (e.g., payment processors, mapping services) as part of its operation. These third parties are responsible for their own terms of service and privacy policies, and you are encouraged to review those policies when using third-party services.
13. Modifications to Terms
Vovalet reserves the right to modify, update, or change these Terms at any time. Any changes will be posted on our website, and the updated Terms will be effective immediately upon posting. By continuing to use our services after any changes, you agree to be bound by the updated Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Vovalet operates, without regard to its conflict of law principles.
15. Account Termination
- Termination by User: You may terminate your account at any time by contacting Vovalet customer support.
- Termination by Vovalet: Vovalet reserves the right to terminate or suspend your account if you violate any of these Terms or engage in fraudulent or illegal activities.
